Straight from the EPA;

Hybrids and electric vehicles can perform differently depending on weather conditions and how they are driven. This complicates developing ratings for window stickers.

“Everybody wants a label that tells you exactly what you’re going to get, but obviously that’s not possible,” Alson said. “A good general rule of thumb is that real-world fuel economy is about 20 percent lower than the lab numbers.”

I think from those comments we can expect that Ford will not get into trouble over the C-Max figures, but the stickers might get modified to include a statement about real world fuel economy varying due to various factors.

I don't know about Canada, but on the US stickers: "Actual results will vary for many reasons, including driving conditions and how you drive and maintain your vehicle."
