on the way to work yesterday.  i was cruising in the left hand lane doing 50 in a 45 zone.  i was approaching slower traffic in the right lane  when the 911 comes zipping up on my right hand side   puts his turn signal on  and starts to come over.  I tap the horn,  he continues to come over.  I edge left and but stay on road so I don't go into the ditch and ease off the gas.  he continues to come over. and I apply the brakes

he ended up in the high sided in the ditch...I've got some minor fender and bumper damage.

I sounds like he will be 100% at fault.

Having said that (and only based on what you wrote)---I see a hi-performance car rushing up beside me in the slow lane and I am in the fast lane---I'm backing off the gas pedal and letting the moron go through.  This collision "appears" to have been preventable.

I had no options...  and the above description is what I gave my insurance company,  which also happens to be his insurance company, no either way they are on the hook.  Police came  and did  an exchange of info.  not sure if the guy got a ticket or not.

Depends on the state, NO ticket in TX if the officer doesn't think any laws were broken, doesn't witness the accident, etc.

$35K+ car built in 1982 I'm thinking the 911 called his lawyer ("morning Tom someone just hit my 911 in the rear") before his insurance co.

Going to be interesting to see who fixes whose car.

  • 4 weeks later...

well got the cmax back form the body shop.  it was down for a week.

My rental car was a Chrysler 300,  While having a big car is nice.  I really enjoyed the fact I could point my right big toe to the ground and the car would jump.  but parking was a PITA,  and 20mpg sucked.

I have a friend who has one.  Nice car but I am kind of a big guy and I have a hard time getting in and out of this with the low roof.   I tried a few times but now we just take the C-Max if we go out with them somewhere.
